Terms of Sale and Payment

From the moment you book a trip with China Escapade (hereinafter will appear under the term "us"), you agree to have read the terms and conditions and our policies. This contract includes all necessary information regarding tours, cruises, flights, trains, hotels, car rentals, guides and other services offered by China Escapade.

The contract states important information regarding payment details and any fees that may apply for certain events. Important information regarding our cancellation and refund policies are as follows:

1.  Registration and conclusion of contract

As soon as we receive an enquiry by phone, e-mail, fax or mail, you are bound by the terms and conditions below.

A. Contract

The minimum legal age to make a booking with our company is 18 years old. Our entire website and its content are, therefore, accessible to and intended for only adults who are 18 and older.

We may require an initial payment and/or your credit card details (e.g. type, name of cardholder, card number, expiration date and security code) to guarantee booking and proceed with finalizing your booking. This information also assists in issuing airline ticket(s) and confirm any hotel reservation(s) for you. Please note that we are not financially responsible for any flight delays and cancellations reported by the airline that may cause an event in China to expire. B. Modification of Contract

The terms and conditions below are subject to change. China Escapade reserves the right to update or cancel these terms and conditions in their entirety or in part at any time, with or without notice. If modified, the new version of these terms and conditions will be posted on our website replacing any previous information. Therefore, it is important to read the terms and conditions each time you visit the China Escapade website.

By booking with China Escapade, you agree to our terms and conditions of sale and those of any hotels and airlines used during your trip.

2. Price

A. Price Description

• Train

The price includes:

  • The price of the ticket.

The price excludes:

  • Food and drinks on board
  • Snacks at the station
  • Expenses for baggage porters

• Hotel

The price includes:

  • Housing and often a breakfast buffet.

Prices given are calculated on the base of a double room at a rate per night, unless otherwise noted. The room is typically available by 11 am and must be vacated by noon the next day.

Excluded from the price:

  • The deposit that is requested upon arrival at some hotels.
  • Personal expenses (e.g. room service, minibar, snacks, laundry, phone calls, etc.). You should be responsible for addressing these expenses before departing your hotel.
  • Additional expenses for an early or late arrival/departure.

• Cruise on the Yangtze River (Chongqing <-> Yichang)

The price includes:

  • Accommodation on board.The price of housing is calculated on the base of a two-person cabin with a private bathroom. In case a customer requires a single room, an "individual cabin" will be requested instead.
  • The group organized excursions and activities mentioned in your program. These activities are subject to change by the cruise line without notice.
  • Food and Drinks: a Western breakfast, Chinese lunch and dinner are served on board everyday. Drink options depend on policies on cruise lines.
  • A tip of 150 Chinese yuan per person and carrier charges amount to 30 Chinese yuan per person.

Excluded from the price:

  • The deposit that is requested upon arriving at your cabin.
  • Service charges and additional expenses including, telephone calls, laundry, drinks on board that are not included as a part of your booking, and so on. Payment of these fees will be required during and/or after your stay on the cruise ship.

• Tours

Private tours:

The price includes:

  • The price of tickets to attractions mentioned in the itinerary.
  • Meals mentioned in the itinerary.
  • A professional, private guide.
  • Air-conditioned private vehicles with a driver.
  • Connections made between hotels and the airport or train station.
  • Hotels (price calculated on the base of a double room) mentioned in the itinerary. When requesting a single room, a single supplement will be charged instead.
  • Domestic flights (economy class) or internal train tickets in the itinerary. All taxes like airport and fuel are included.
  • Management fees and government taxes.
  • Insurance services offered by travel agencies.

The price excludes:

  • Cost of international transportation needed to enter and leave China.
  • Cost of Chinese VISA.
  • Personal expenses (e.g. laundry, extra drinks, phone calls or excess baggage costs).
  • Tips for guides and drivers.

Group Tours (Join-in Tours)

The price includes the following:

  • Entry price for tickets to tourist attractions in the itinerary.
  • Meals in the itinerary.
  • A professional guide.
  • Vehicle with air conditioning system and its driver.
  • Connections made between hotels, airport and/or train stations.
  • Hotels (price calculated on the base of a double room) in the itinerary. If a request for a single room is made then a single supplement is provided.
  • Domestic flights (economy class) or train rides in the itinerary. All taxes such as airport and fuel are included.
  • Management fees and government taxes.
  • Insurance services run by travel agencies.

The price excludes:

  • The cost of international transportation required to enter and leave China.
  • Chinese VISA cost.
  • Personal expenses such as laundry, drinks, telephone calls or excess baggage costs.
  • Tips for guides and drivers.

Additional Remarks:

a. Outside the occurrence of exceptional events, rates mentioned above will be enforced between December 2014 to November 2015.
b. Rates for children are given upon request.
c. Other than exceptional cases, final payment must be made no later than 30 days before the departure date.

B. Description of components of the price

Vehicle driver

If you book a private tour through China Escapade, guides and transportation services will only be reserved for you, your group, family and friends. No other participants will be included in your group. If you choose a bus tour (sit-in-coach tour) then you will share the bus and the tour guide with other participants who have also reserved these services.

Entrance tickets

The prices of tickets to any tourist sites in the program are based on the current year’s prices, which are subject to change.

Meals

For organized tours, a western breakfast is served in most hotels in the city. In remote areas, however, only a Chinese breakfast is available. In restaurants, Chinese lunch and dinner is often served with a glass of a soft drink.

Travel Guide

A local guide will accompany you to every area except regions that don’t require a guide or per your request.

Transfers

Take into account all transfers that are arranged for you and all of your group members between the airport, hotels and various tourist sites, considering that independent arrivals or departures may require additional fees.

Housing

The price of the hotel accommodation is based on a standard double room shared by two people. If a request for a single room is placed, the single supplement fee will be instated.

Domestic transportation

The price of economy class tickets for domestic flights will be in the itinerary. Airport and fuel taxes are included in these prices. We can book a first class ticket upon request, which is subject to the airline’s availability and cancellation insurance.

Domestic railway travel includes soft seats or berths unless special conditions are requested.

Management fees and government taxes

Management fees and government taxes imposed by cities are included in the price.

Cruise

The price of on board accommodations are based on the occupancy of a cabin of two people.The price includes daily excursions and scheduled meals.

Entry Permit of Tibet

If Tibet is a location you’ve chosen as part of your itinerary, the cost for an entry permit to Tibet is included.

C. Price Increase

We reserve the right to increase the price when there are increases in the cost of transportation (e.g. increase in fuel prices), new taxes or increased taxes (e.g. airport taxes), changes in exchange rates and value added tax. We calculate the increase on the base of actual, additional costs on receipt of payment.

3. Cancellation and refund

We understand that you may need to cancel your planned trip to China. However, if you wish to cancel a reservation you have made with China Escapade, we must receive a handwritten request as soon as possible.

After receiving a cancellation request, we will refund booked services within 14 days.

However, all bookings may not be canceled and some cancellation fees are charged as a result. We welcome any questions that you may have about cancellation and refund policies during the booking process.

These cancellation fees vary according to services booked and will be deducted from the total amount paid. Here are additional details.

A. The service charge

Once a reservation is made, service fees are added to the transaction. If you need to cancel a tour or any other service cancellation fees are required. They are calculated as follows:

The service fee corresponds not only to loss of booking services, tourist attractions and activities, but also for services of any guides, drivers and agencies that were going to be provided.

If a customer decides to cancel a tour that in progress, the customer will not receive a refund. If the client does not attend one of the services provided because of an early departure or late arrival, no refund is administered.

Since we know a serious reason may require you to cancel your holiday and booking, our cancellation policy may be requested on a case by case basis. If you want this policy delayed on your own case, you can simply send a request along with evidence of the occurrence. We will do our best to help you in this circumstance.

If you're going through China Escapade only for transportation or housing services, there will be no service charge for cancellations. If your tour includes transportation, the cancellation charge for these services will be added to the initial cost of the overall service. Please refer to conditions set out below

B. Flights

Cancellations and refunds depend on the airline that was selected for booking. It is important to carefully read the "terms and conditions" of various airlines you book your flights. If your flights are booked by us, be sure to check with your travel agent on these details.

Airlines routinely ask you pay additional fees in case of any cancellation of a flight that was previously booked. However, some tickets with preferential rates are nonrefundable. Flights from mainland China to Hong Kong are also subject to different terms.

Cancellation insurance for domestic flights are often not included upon booking. If you request this service beforehand we will assist you in fulfilling this request. This insurance will refund your money in case of any cancellation.

C. Train tickets

It is difficult to cancel a train ticket issued to a foreigner in China. China Escapade, however, will help make any necessary arrangements, except in the case where there are time constraints. 

These cancellation fees are calculated below:

These terms apply ONLY to tickets booked for Chinese domestic trains. Trains to Hong Kong have specific cancellation policies. During the booking process, please discuss any conditions unique to your case with travel agents that warrant attention.

D. The cruise on the Yangtze River

During certain times of the year, the cruise on the Yangtze River is extremely popular. Therefore, cancellation requests last minute may not be possible.

Generally, any cruise line will refund the reservation less than 15 days before the start of the cruise. By placing your cancellation request early enough, you are more likely to receive a full refund.

E. Hotels

Most standard hotels booked by China Escapade accept reimbursement of benefits but require a fee to do so. These fees are shown below:

If you have booked a boutique hotel or guest house, which have homeowners with less-developed networks, it is not likely that a refund will be issued. These owners do not often provide refunds after receipt of payment. Nonetheless, we will try to discuss with the landlord to get a partial or full refund.

4. Modification of the route

A. If you decide to change the itinerary

No change fee is required on our part to each change request. In addition, any changes made to the itinerary before confirming any booking is made without additional costs.

Our goal is to always offer the best possible service. If you want to change an aspect of your route (e.g. add attractions, change your daily schedule, change the choice of a hotel, etc.) after confirmation of your reservation or during your trip, then we will do our best to acquiesce your request according to what’s available.

Since any booking accommodation is made several weeks in advance, we cannot guarantee your change requests can be met.

If we are able to respond to a new request after bookings are made, an additional fee may be required if there is a large price difference.

B. If we have to change the itinerary

We do our best to offer you our services as presented while booking. However, it may happen that we need to make changes to our route at the last minute.

If an independent event beyond our control (e.g. a war, fire, hurricane, epidemic, health risks, dangerous weather conditions, a new law or regulation etc.) occurs, we would be forced to make such changes. If the price difference is too large, we will ask you beforehand if you’re willing to accept the additional costs.

Once there, if it is discovered by the guide that you are not in a physical condition to make the trips, we are entitled to change your route for your best interest (e.g. adding a chairlift in rugged areas to ensure of a most safe passage, etc.).

If supplements are requested by a third party such as a cruise operator, airline or hotel, no fee will be charged to you.

China Escapade reserves the right to adjust the itineraries of its routes in the case of any changes in schedules, locations due to conditions beyond their control that would require such changes.

C. Transferring packages

If you are unable to go on a trip, you can give your package to a person of your choice, provided that he/she meets the requirements in time to participate in traveling (i.e. visa, passport, etc.).

China Escapade should be informed of this change at least a week before their departure to make any necessary provisions.

5. Payment

When paying, make sure to specify the code of the tour so we receive payment without difficulty. You are welcome to send us the bank receipt (or a screenshot of online payment) by e-mail or fax, once payment has been made.

Once we receive payment all of your reservations will be confirmed.

A. Deposit and final payment

A nonrefundable deposit of US$150 per person is required at the time of booking.
All and/or the last portion of payment is required 30 days before departure, except in exceptional cases.
If a customer reserves a tour less than 30 days before departure, full payment will be required immediately.
During late registration, all fees must be paid at registration. We are only liable for the completion of the contract and its designated service when your payment has been confirmed by us. If your payment does not reach us in time, we reserve the right to withdraw from the contract.

6. Claims

If you have a complaint about our services while booking with us, please notify the local guide directly and tell your travel agent. We will inform the local service provider responsible so that the reported inconvenience does not occur again during your stay.

However, if you are still not satisfied and want to obtain compensation, please send a letter by mail, fax or email within 15 days of the end of your tour so your application is processed promptly. Relevant receipts and supporting documents must be enclosed with the letter.

China Escapade disclaims any liability to claims made more than 15 days after the end date of your tour.

7. Insurance

Your trip is covered by the Travel Agency’s Liability Insurance, which is directly regulated by the National Tourism Administration of China. This insurance covers accidents during any service caused by the travel agency. It doesn't cover any incidents or physical problems that occur outside of the tour caused by clients themselves. Therefore, we recommend you buy additional travel insurance in your home country before traveling abroad. You can also inquire at your bank because some credit cards include travel insurance when a plane ticket is purchased.

8. Our responsibility

China Escapade, its agents and affiliates note its responsibilities in the contract, our website and on materials given related to your booking. As a tour operator, we organize, market and sell tour programs consisting of a set of services including, guides, land, air, and maritime transportation, excursions and accommodations that we buy or reserve from various suppliers.

Our service providers are independent contractors and are neither representatives or employees of our company.

As we are committed to booking your air and maritime transportation, we act in the capacity of an entity that is representative of you. However, we don’t act in any case or in part of airline or sea employees. Instead, we commit our efforts and take responsibility for the implementation of voluntary negligent acts by our partner travel agents regarding local services.

The prices in the contract may not be modified, except for when there’s any variation in transportation costs, taxes or exchange rates. The agreement must provide opportunities for price adjustment (upward or downward) and the method of calculation if such revisions must be made. If the price increase exceeds 20% of the original cost, you can cancel your contract without penalty. In any case, the initial price of the contract cannot be increased within thirty days of departure.

China Escapade reserves the right to modify errors in pricing or promotional rates, which may cause an increase to the total price of a tour. Such an increase may be due to a change in the price of plane tickets, the price of a cruise, any currency devaluation, an increase in the input prices on sightseeing, taxes and/or fuel surcharges charged before final payment.

In addition, China Escapade reserves the right to accept or reject any participant, to disqualify an entrant for a tour, to make changes to any route and even cancel one of its tours at whenever we deem such action is necessary to ensure the comfort and/or safety of all participants. In the potential situations described above, participants will be fully reimbursed for payments made for services that they will not receive.

China Escapade reserves the right to change a hotel, travel booking/reservation by plane, train or boat, to reroute or cancel a tour before departure for valid reasons and after consulting with clients.

9. Release

China Escapade is not responsible for any loss, injury or damage to persons or property during conditions such as fire hazards, malfunctions of machinery or equipment, a decision by the government or any other authority, war (whether declared or not), civil disturbances, strikes, riots, theft, quarantine, customs and sanitary regulations, or any other action or condition beyond our control.

China Escapade may be liable for additional costs induced or supported by participants on the trip due to one of the elements mentioned above.

China Escapade disclaims any liability to any negligent or unfair act, omission or failure to use equipment by a supplier such as a carrier, cruise operator, hotel or any third party who is not under the direct control of China Escapade.

China Escapade is not responsible of noncompliance with customs rules by of its clients.

China Escapade rejects any liability for the loss or theft of anything of value and/or personal item belonging to a client when such an event is due to negligence by the client himself/herself.

The contract is valid only if respect for the law by both parties is adhered. If it is discovered that a client has provided false information about his or her identity and/or travel documents, papers, China Escapade does not bear any responsibility for the resulting consequences
